Verified Card Grading – Terms and Conditions

Welcome to Verified Card Grading (“VCG,” “we,” “our,” or “us”). By submitting your cards to Verified Card Grading through our website at https://www.VCGgrading.com , you (“you,” “your,” or “Customer”) acknowledge and accept the following Terms and Conditions (“Terms,” “Agreement”). If you do not agree with any part of this Agreement, please do not use our services.
1. Agreement to Terms
1.1. By sending your cards to Verified Card Grading or accessing our services in any form, you agree to comply with and be legally bound by these Terms. These conditions apply to all individuals using our services.
1.2. You understand and accept that Verified Card Grading is entitled to enforce and benefit from this Agreement in full.
2. Services Overview and Timeframes
2.1. Verified Card Grading offers professional evaluation, grading, preservation, and encapsulation of trading cards. While we aim to meet estimated turnaround times, all delivery timelines are approximate and may vary. Delays may occur due to unforeseen circumstances, and we are not responsible for any resulting losses.
2.2. Authenticity Disclaimer: Our assessments represent our expert opinion at the time of review. While we use high standards in detecting fakes or alterations, no method is infallible. You agree that there is an inherent risk when submitting cards and that Verified Card Grading cannot guarantee 100% detection of counterfeit or modified items.
3. Submitting Your Cards
3.1. Prohibited Submissions: You agree not to submit cards that are intentionally altered, counterfeit, trimmed, or tampered with in any way. Verified Card Grading reserves the right to reject such cards.
3.2. Right to Decline: We may, at our sole discretion, decline to process any card. If resources are expended on examining a card later found to be inauthentic or ungradable, you may be charged for the evaluation effort.
3.3. Your Warranty: By submitting a card, you confirm to the best of your knowledge that it is authentic and unaltered. Verified Card Grading bears no responsibility for grading cards that are later revealed to be fake or tampered with if those issues were not reasonably detectable during our review.
3.4. Submission Kit Policy: Once a Submission Kit is shipped to you, the $5 fee is non-refundable. This fee covers the cost of consumable materials and shipping. If your order is canceled before the kit is sent, a full refund will be issued.
4. Subjectivity in Grading
4.1. Grading is Interpretive: Grading involves subjective analysis. Evaluators may differ in their assessment of a card’s condition. You acknowledge this and accept that our grading decisions are final.
4.2. No Guarantees or Refunds: Grading outcomes are not guaranteed and cannot be contested once the process begins. Fees are non-refundable regardless of your opinion of the final grade.
5. Handling, Insurance & Responsibility
5.1. Card Care: Verified Card Grading agrees to handle all submitted cards with reasonable care from the time they arrive at our facility until they are returned or otherwise disposed of in accordance with these Terms.
5.2. Compensation for Loss or Damage: If a card is lost or damaged due to our negligence, we will compensate you based on the fair market value as determined by us, up to the declared value listed in your submission form.
5.3. Declared Value: You are required to provide a good-faith declared value for each card. This value affects insurance and service eligibility. If we believe your declared value is inaccurate, we may adjust it and revise fees accordingly. If you do not accept the new terms, we reserve the right to retain your cards to cover our costs.
5.4. Limit of Our Responsibility: Our maximum liability, under any circumstances, is the lower of (a) the fee paid for the service or (b) the declared value of the card.
5.5. Post-Delivery Claims: Upon receiving your graded cards, inspect them immediately. Any issues must be reported within 5 business days. If an error is found, you agree to return the card for correction.
5.6. Damage After Shipping: Once your cards leave our facility, we are not liable for any damage or mishandling that occurs during or after shipping, including damage caused by you or third parties opening the encapsulation.
6. Fees, Payment, and Ownership Rights
6.1. Service Fees: You agree to pay all applicable service fees, including grading, additional authentication, and any special handling charges. All fees are final and non-refundable once grading has begun.
6.2. Lien and Ownership Rights: Verified Card Grading maintains a security interest in all cards until payment is received in full. We may retain possession or sell cards to recover unpaid amounts.
6.3. Billing Authorization: You authorize us to charge your stored payment method upon completion of grading or at the time of intake if invoiced upfront. You must keep your billing information up to date.
6.4. No Chargebacks: By using our service, you agree not to dispute charges with your payment provider for services that were properly rendered under these Terms.
6.5. Abandonment Policy:
- Any unpaid order older than 90 days will be considered abandoned.
- We may liquidate the cards to recover our costs.
- Any remaining value will be applied as store credit (not redeemable for cash).
- We will make reasonable efforts to contact you before taking such action. You are responsible for keeping your contact details current.
7. Legal Limitations and Disclaimers
7.1. Maximum Liability: Our financial responsibility is limited to the fees you paid for the grading service of the affected card(s).
7.2. No Indirect Damages: We are not liable for incidental, indirect, special, or consequential damages, even if we were advised of the possibility.
7.3. Service Disclaimer: We provide services “as is” and do not guarantee that all alterations or counterfeits will be detected. No warranties of any kind, express or implied, are made.
8. Third-Party Submissions
8.1. Authorized Submissions: If someone submits cards on your behalf, you affirm they have the authority to act for you, and that you remain bound by these Terms.
8.2. No Responsibility for Third Parties: We are not liable for any issues between you and a third party who submits or collects cards on your behalf.
9. Legal Jurisdiction and Disputes
9.1. Governing Law: These Terms are governed by the laws of the State of Indiana.
9.2. Legal Venue: Any disputes must be resolved in the courts located in Porter County, Indiana.
9.3. Legal Costs: If a dispute arises and legal action is taken, the party who prevails is entitled to recover reasonable legal fees and costs.
10. Complete Agreement and Severability
10.1. Full Agreement: These Terms represent the entire understanding between you and Verified Card Grading and replace any previous agreements.
10.2. Invalid Provisions: If a court finds any part of this Agreement unenforceable, the remaining sections will continue in effect.
10.3. Additional Documentation: You agree to sign any additional documents that may be required to carry out the intent of this Agreement.
11. Acknowledgment
11.1. By using our service or submitting cards, you confirm that you’ve read, understood, and agree to these Terms. You also confirm that you had the opportunity to seek independent legal advice before accepting them.
12. SMS Notifications
12.1. Consent to Text Messages: If you provide your mobile number, you consent to receive order updates and service-related messages via SMS from Verified Card Grading.
12.2. Message Frequency: You may receive up to 15 messages per month per order.
12.3. Carrier Fees: Your carrier may charge for text messages. Verified Card Grading is not responsible for these charges.
12.4. Unsubscribing: To opt out of SMS updates, reply STOP. You may receive one final confirmation text.
